Privacy Policy

This Privacy Policy (hereafter “Policy”) describes the personal data collected or generated (processed) when using the Moellhausen websites http://www.moellhausen.com/ and https://magazine.moellhausen.com/ (hereafter, in short, “Websites”). This “Policy” describes the types of personal data that are collected through our Websites and the way in which the personal data are collected, shared and protected.

Personal Data subject to processing

The Personal Data collected, meaning any information that enables us to identify you directly or indirectly.

The computer systems and software procedures that operate the Website acquire, during the course of their normal operation, some data whose transmission is implicit in the use of the internet network, based upon the TCP/IP protocol. This information is not collected to be associated with identified data subjects but, by its very nature, it may enable you to be identified when you are browsing.

This category of data includes the “IP addresses” or domain names of the computers used by you when connecting to the Website, the addresses in URI (Uniform Resource Identifier) notation of the requested resources, the time of the request, the methods used to submit the request to the web server, the size of the file obtained in response, the numerical code indicating the status of the response given by the web server (successful, error, etc…) and other parameters relating to your operating system and computer environment.

These data are used for the sole purpose of managing requests by you in accordance with Art. 6, letter b) of the GDPR, as well as to obtain anonymous statistical information on use of the Website and to verify that it is functioning correctly, in accordance with Art. 6, letter f) of the GDPR.

The aforementioned data may also be used to ascertain any liability in the event of cybercrimes in detriment to the Website or other websites connected or linked to it: except in this circumstance, the browsing data will be erased immediately after the respective statistical processing and they are in any case stored for 24 months from the time of collection.

Any request sent by you by email to the addresses indicated in the specific section of the Website involves the subsequent acquisition of some of your personal data (including your email address), which are required in order to respond to your requests.

The data collected in this manner will be processed by the Controller in accordance with Art. 6, letter b) of the GDPR and for the sole purpose of correctly managing your requests.

Processing purposes

Some personal data may be requested for the purpose of supplying the requested products or services. These personal data include:

  • Contact details, including name, email address, telephone number, shipping and billing address
  • Access and account information, including screen name, password and unique user ID
  • Your personal preferences, including preferences regarding marketing and cookies.

We use the personal data collected in the following ways:

  • To ensure the Websites operate efficiently
  • To communicate information about our products, services and events and for other promotional purposes
  • To carry out, improve and maintain our business, products and services
  • For general research and analysis purposes:
    We use the data on how visitors use our websites, apps and services to gain an understanding of the behaviours or preferences of our customers. For example, we may use the information about how visitors to the Websites seek and find products in order to ascertain the best ways of organising and presenting the products.
  • Other purposes:
    We may also use the personal data in other ways, in which case we will provide a specific communication upon collecting the data and will request your consent, where necessary.
  • The aforementioned consent will be requested in order to be able to receive and respond to requests for products and prices made by you when using the Websites.

Personal Data sharing

Moellhausen shares your personal data with:

  • companies forming part of the “Moellhausen” group for the purposes and under the conditions described above.
  • Service providers that process personal data on behalf of Moellhausen, for example, for processing data, for sending emails, for research and analyses, for managing product promotions, as well as for administering certain services.
  • Other third parties to the extent necessary to: (i) fulfil a request of the Government, an order of the court or to comply with the applicable laws; (ii) prevent illegal uses of our Websites; (iii) defend ourselves against third party claims; and (iv) facilitate fraud prevention or investigation (e.g. counterfeiting).

Those recipients process the personal data in the capacity of autonomous controllers or processors, as appropriate. The categories of autonomous controllers and the list of processors to which the data may be communicated can be requested from the Controller.

Furthermore, natural persons belonging to the following categories may come to know of the data in the capacity of persons authorised to process and in relation only to data necessary for the conduct of their assigned duties: the Controller’s employees or persons seconded to it, temporary workers, interns, consultants and employees of external companies appointed as processors.

Personal Data protection

Encryption and security: we use a variety of technical and organisational safety measures, therein including encryption and authentication tools, to maintain the security of the personal data. The personal data are contained in protected networks which can only be accessed by a limited number of persons who have special rights of access to those systems.

International data transfers: the personal data we collect or produce (process) in the context of our Websites will be archived exclusively in Italy.

Data storage

The Controller will process the information collected insofar as is strictly necessary to pursue the pre-determined processing purposes. At the end of the aforementioned storage period, the information will be erased or stored in a form that prevents you from being identified (e.g. irreversible anonymisation), unless its further processing is necessary for one or more of the following purposes: i) to resolve pre-litigation disputes and/or litigation brought prior to the expiry of the storage period; ii) to follow up on investigations/inspections by internal control functions and/or external authorities begun prior to the expiry of the storage period; iii) to follow up on requests of the Italian and/or foreign public authority received by/served upon the Controller prior to the expiry of the storage period.

Personal Data rights

You have the right to obtain from the Controller confirmation as to whether or not personal data concerning you are being processed and, where that is the case, you have the right:

  • to obtain access to the personal data, request the rectification or erasure of personal data or the restriction of processing of personal data relating to you or to object to their processing;
  • to receive in a structured, commonly used and machine-readable format the personal data relating to you and to send those data to another controller (data portability);
  • to be informed of the existence of an automated decision-making process, including profiling;
  • to withdraw consent, if expressed, at any time without prejudice to the lawfulness of processing based upon the consent before its withdrawal;
  • to lodge a complaint with the supervisory authority.
